Home game poker is a gray area in Kansas rather than clearly permitted: Article 15, Section 3 of the Kansas Constitution prohibits lotteries and gambling except as specifically authorized, and no general social gambling exception exists. The state has four state-owned casinos and several tribal gaming operations.

Kansas does not have a general social gambling exception. Gambling is defined broadly under K.S.A. 21-6403 and criminalized under K.S.A. 21-6404, and real-money poker conducted outside a licensed state-owned or tribal facility can qualify as illegal gambling even without a rake. Prosecution of small private games is rare, but the prior 'generally legal' characterization overstated the protection available.
